Putting people back at the center of the debates

When the amicable phase has failed, but we have managed to locate the debtor and get in touch with him, we will be able to offer you a home visit directly to the debtor's address (Company and Personnel).

This is the final attempt at an amicable debt recovery.

The aim is to put the human element back at the center of negotiations and to avoid legal proceedings.

Today we are able to offer you a home visit anywhere in Metropolitan France and the French Overseas Departments and Territories, but also recently internationally, depending on the countries that allow the visit.

Timeframe: Within 1 month after client agreement, depending on the agent's tour schedule.

Concilium Group Debt Collection

Twenty years ago, Andrés Solana (who joined us in September 2018 as deputy director) had the idea of ​​creating a network of debt collection agencies called Concilium . Concilium members are responsible for conducting home visits for the association's members.

This is a group of debt collection agencies operating throughout France and its overseas territories, whose mission is to carry out home visits in our respective regions at the request of one of the colleagues in exchange for a success fee defined beforehand.

Each firm is autonomous and must meet the criteria set out in the charter:

  • Compliance with regulations
  • Adherence to the scheduled visit deadlines.
  • Provide a detailed report of the visit including one or more photos.
  • Always carry out the visits for which he has agreed responsibility.
  • Introduce yourself as a debt collection agency during the visit
  • To be commissioned only on the percentage stipulated in the contract and to claim nothing more.
  • To avoid resorting to a lengthy and costly legal procedure
  • To receive an appropriate response to the dispute received (simple oversight of payment, negligence, misunderstanding, desire not to break a business relationship…)
  • To gather all the information relating to the actual situation of your debtor (the agent's eye and his report will allow us to classify the case and therefore to direct your case with full knowledge of the facts).
  • The agent will attempt to achieve full recovery of the debt, either immediately or by using a payment schedule which he will ensure is respected
  • Of course, in the case of your consultation, advice will be given to you on the direction we believe we should take for the case in progress.

Home visits offer a quick and cost-effective alternative to lengthy and expensive legal proceedings. They can resolve a variety of disputes, from simple payment oversights and negligence to misunderstandings or a desire to maintain a business relationship. These visits also facilitate the collection of necessary documents to contest a debt in criminal or civil proceedings, while respecting the rights of the defense.

Interventions must comply with the Code of Criminal Procedure and the Book of Tax Procedures, in order to respect public order and the inviolability of private residences. If an offense is observed, magistrates and the public prosecutor may order searches or home visits, subject to authorization from the judge of liberties.

Example of a home visit case

Summary of the situation

An IT maintenance company provided services to a small business, but despite several reminders, the invoice remains unpaid. The small business, which had previously promised prompt payment, is no longer responding to calls or emails. The creditor company then decides to use a debt collection agency to recover the outstanding amount.

Solution

Acting on behalf of the maintenance company, we took several steps to contact the debtor. We used the company's email address and phone number, without success. Registered reminder letters were sent, but they remained unclaimed at the post office. It became clear that the debtor was trying to avoid any contact.

Faced with this impasse, we decided to conduct a home visit at the SME's headquarters. During our first attempt, we only found the secretary, who informed us that the manager was often absent. We left her a notice. The second visit, scheduled for a different time, finally allowed us to meet the manager on site.

After a frank conversation, the debtor explained that he was going through a difficult financial period, but that he was willing to rectify the situation. We agreed on a payment schedule spread over three months, which will allow the SME to repay its debt without jeopardizing its business.

Results

The home visit allowed us to open a dialogue with a debtor who had been avoiding formal contact. By respecting current legislation (articles R124-1 to R124-7 of the Code of Civil Enforcement Procedures), we were able to reach an amicable agreement. It is important to remember that these visits must always be conducted respectfully and professionally, without exerting any undue pressure. This often allows us to resolve seemingly intractable situations, while preserving the business relationship.
